Probantus Group is a collaborative network of academics in business, economics, and statistics. We focus exclusively on these disciplines so counsel can rely on depth, quality, and fit.

Having testified in a number of North American commercial disputes and class action cases (plaintiff and defense), we noticed a discrepancy in Canadian litigation, where a large percentage of experts, especially in the business and economics fields are not Canadian. This is surprising since Canadian academics speak “Canadian”, have Canadian temperament and mannerisms, abide by the Canadian ethical standards, exercise greater rigor, are more esteemed in Canadian courts, and are far cheaper than their American counterparts.

Our take on this discrepancy is that Canadian academics are less familiar with the litigation world and are less prepared writing court case reports and for the rigors of cross-examination, but we also find that attorneys do not have the tools to find Canadian academics with the matching expertise—that would take knowing these academics personally, their areas of interest in research, teaching and consulting. Expert Witness Matchmaking services provide some relief but are generally expensive (even if they advertise no-cost) and still use resume matching software, rather than personal knowledge of the academics in question.
